The Supreme Court Friday issued notice to the Medical Council of
India and the Directorate General of Health Services on the central
government's petition seeking approval for providing 22.5 percent
reservation for Scheduled Caste/Scheduled Tribe candidates under the
all-India quota in postgraduate medical admissions for the academic
year 2007-2008.
For 2006-2007, the central government had not provided for SC/ST
reservation under the 50 percent all-India quota following a 2005
apex court judgment, which had said that the 50 percent all-India
quota should be excluded from reservation. As a result reservation
was provided only under the 50 percent state quota. For this year,
the central government filed a petition seeking the apex court's
approval for providing SC/ST reservation under the 50 percent
all-India quota.
A three-judge bench comprising Chief Justice Y.K. Sabharwal, Justice
K.G. Balakrishnan and Justice C.K. Thakker issued the notice after
hearing Additional Solicitor General Gopal Subramanian.
He said that the matter required urgent consideration as the
all-India postgraduate entrance examination for 2007 conducted by
the All India Institute of Medical Sciences was scheduled to be held
on Jan 14 and the results would be declared in the middle of
February.
The centre in its petition said that providing 15 percent
reservation for SCs and 7.5 percent reservation for STs under the 50
percent all-India quota would not only be beneficial to those
communities in the states but also in other parts of the country. It
sought a formal approval to give effect to the SC/ST quota.
